What Documents Will I Need to File Chapter 13 or Chapter 7 Bankruptcy?

In order to prepare a petition under Chapter 13 or Chapter 7 bankruptcy, the client will need to provide certain documents. Although each case is different some of the typical documents needed are as follows:

Required Documents for Chapter 13 or Chapter 7 Bankruptcy:

  1. Last 2 years tax returns with W-2s
  2. Proof of income during the last 6 months from any source i.e. paystubs; social security; pension; child support etc.
  3. Proof of income and expenses for non-filing spouse
  4. Titles to all vehicles or other titled property
  5. Deed, mortgage statements and property tax bills
  6. Recent bank or other financial statements
  7. General list of creditors
  8. Information on any inheritance a client may have
  9. Information on any personal injury actions pending or that the client plans on filing or other actions or lawsuits in which the client has a financial claim
  10. Information on any tax liabilities owed
  11. Retirement account statements
  12. Information in regard to any transfers of any assets within the last2 years
  13. Information in regard to any payments to relatives within the last year

Since obtaining these documents may be difficult or time consuming, we recommend that the client schedule an initial consultation to discuss their financial situation. At the initial consultation, we will provide the client a list of the documents that we will need to prepare their case.
